Buying Miami Real Estate Without a US Social Security Number

You do not need a US Social Security number to buy real estate in Florida. What you eventually need is a US taxpayer identification number, and if you are not eligible for an SSN that means an IRS Individual Taxpayer Identification Number. The distinction matters because of when each one bites: nothing about the purchase requires a number, and almost everything about the tax machinery attached to the property does.

What an ITIN is, and what it is not

The IRS describes an ITIN as a nine-digit number it issues to people who need a US taxpayer identification number for federal tax purposes but are not eligible for a Social Security number. It covers resident aliens, non-resident aliens and their dependents, wherever there is a federal tax purpose.

What it is not is worth stating plainly, because it is the most common misunderstanding in a first cross-border conversation. An ITIN does not authorise work in the United States. It confers no immigration status. It does not qualify the holder for Social Security benefits or the Earned Income Tax Credit. It is a filing number and nothing else. If you later become eligible for an SSN, you stop using the ITIN and tell the IRS to consolidate the records.

Where the number stops being optional

FIRPTA is what turns the ITIN from useful into mandatory. Treasury Decision 9082 requires all transferees and foreign transferors of US real property interests to provide their taxpayer identification numbers, names and addresses on the withholding returns and related forms when a US real property interest is disposed of.

The timing is the trap. If you leave the application until you are selling, the seven-week processing window can run past the closing date — and the closing date is when the withholding happens. Applying at purchase, when there is already a federal tax purpose, costs nothing and removes the problem entirely. This is the single most useful thing on this page.

Opening the account

Federal regulations at 31 CFR 1020.220 let a bank identify a non-US person without a taxpayer identification number, accepting instead a passport number and country of issuance, an alien identification card number, or the number and country of issuance of another government-issued document evidencing nationality or residence and bearing a photograph.

That is the floor, not the practice. Individual banks set onboarding policy well above the regulatory minimum, and it varies substantially between institutions: whether an in-person appointment is required, what minimum balance applies, which countries of residence are accepted at all. Plan to approach more than one, and plan for the appointment. This is usually the slowest moving part of a cross-border purchase, and it does not depend on having found a property, which is exactly why it should start first.

Buying in an entity, and what changed in 2026

Entity purchases — usually an LLC or a trust — are taken up for liability separation and estate planning. Privacy used to be a third reason, and that reason is now substantially weaker.

FinCEN's Residential Real Estate Rule requires the title agent, attorney or other closing professional to report beneficial ownership information on non-financed residential transfers to a legal entity or trust. The rule was published with a 1 December 2025 effective date and compliance subsequently moved to 1 March 2026. The reporting is not public, but it exists, and an entity is no longer a way to keep a name off a filing.

The recurring cost is the part most often forgotten after closing. A Florida LLC annual report costs $138.75 filed between 1 January and 1 May. Filed after 1 May it carries a $400 late fee. That is a firm deadline attached to a structure that people set up once and then stop thinking about.

Whether to hold in an entity at all is a tax and liability question for a cross-border accountant, not a real estate question. What this page can tell you is that privacy is no longer the argument it was.

A workable order of operations

  1. Settle the holding structure with a cross-border accountant before making an offer. Changing it afterwards means unwinding a closing.
  2. Start the bank account. It is the slowest step and it does not depend on finding a property.
  3. File Form W-7 once there is a federal tax purpose. Early, not at sale.
  4. Go under contract — and note that if the seller is foreign, you are the withholding agent under FIRPTA, which is a liability that runs the other way.
  5. Read the condominium file properly. Reserves, the milestone position and the leasing rules land on a foreign buyer and a domestic buyer in exactly the same way.

Do I need a Social Security number to buy property in Miami?
